Registration Forms and Personal Data By completing and submitting the registration form on this site, you will be able to access the discussion board with the ability to comment and the blog system. By doing so, you will be providing AFROWOMEN™ in Digital with certain data. AFROWOMEN™ in Digital collects and uses two types of data about users of its sites: (1) Personal Data – (names and addresses, etc.) via which it is possible to identify an individual from that information; and (2) Aggregated Data – being all other information that relates purely to generic statistics such as traffic flow and demographics.

Personal Data AFROWOMEN™ in Digital will only collect, use, and transfer Personal Data about you if you have consented to that collection, use, and transfer, unless AFROWOMEN™ in Digital believes that such action is necessary to (a) conform to legal requirements, (b) protect and defend its rights or property, (c) enforce this User Agreement, or (d) act to protect the interests of its users or others.

You give your consent in the following way:

By completing and submitting the Registration Form, you automatically consent to AFROWOMEN™ in Digital:

  1. Collecting the information that is on the Registration Form, and information about your movements around and use of this site and other AFROWOMEN™ in Digital owned or managed sites, for the purposes described below.
  2. Contacting you with relevant material, for example, about your use or potential use of this site.
  3. Transferring your Personal Data to AFROWOMEN™ in Digital’s site franchise partner if this site is one which AFROWOMEN™ in Digital publishes and manages for a third-party franchise partner (e.g., an organization), and to that franchise partner contacting you with other relevant material.
  4. Transferring your Personal Data to any data processors that AFROWOMEN™ in Digital has nominated to act as its agent for any of the above activities. The data will always remain under the control and direction of AFROWOMEN™ in Digital.
  5. Transferring your Personal Data to any country in which an AFROWOMEN™ in Digital server is located for the purpose of providing you the sites and services within AFROWOMEN™ in Digital’s network and for conducting the above activities.

Aggregated Data Other non-personal information will be collected and used by AFROWOMEN™ in Digital and may be transferred to third parties. Any such statistical or demographic information will not include personal details through which you could be identified. In addition to the non-personal information given on your Registration Form, information is automatically collected about traffic around the site. This is also only used in aggregate form and no individual registered user will be identified.

Cookies AFROWOMEN™ in Digital uses “cookies” to speed up access to the site (it bypasses checking the registered user database) or to determine whether a user is signed in or not. A cookie is a small piece of information sent from AFROWOMEN™ in Digital to your computer to help us to identify you quickly. Security Security is paramount to AFROWOMEN™ in Digital in respect of your data. We use a variety of software to ensure appropriate security and encryption. Intellectual Property Rights in the Content of the Site AFROWOMEN™ in Digital Content All material on the site, such as text, graphics, logos, button icons, images, audio clips, and software, is owned by AFROWOMEN™ in Digital and is protected by copyright and trademark laws. You may not copy, modify, reproduce, republish, post, transmit, or distribute in any way any material from this site including the underlying code and software, save as authorized by this agreement. You are only authorized to use the site and its contents for your personal, non–commercial use. This amounts to viewing the site and printing off individual pages or sections for personal use.

User Content Any content provided by you by, for example, posting messages to bulletin boards or chat forums, uploading files, inputting data, or engaging in any other form of communication through this service, although owned by you, is subject to a royalty-free, perpetual, non-exclusive, unrestricted, worldwide license allowing AFROWOMEN™ in Digital to use, copy, sublicense, adapt, transmit, publicly perform or display any such content. This license does not apply to the message content of your personal messaging (PM) account, the privacy and integrity of which will be respected at all times.

AFROWOMEN™ in Digital’s Obligations AFROWOMEN™ in Digital will use its reasonable endeavors to ensure that the site and the facilities thereon (including newsletters, personal email, and chat forums – Community Services) are available at all times and that AFROWOMEN™ in Digital supplied content on the site is true, accurate, and error-free. However, we do not guarantee this and provide no warranties unless specifically stated.

User Obligations You warrant that all content submitted or posted by you to the site does not violate the rights of any third party, including, but not limited to, infringing intellectual property rights. In relation to the site and the Services, you may only use these for personal non-commercial purposes. You will ensure that all information provided on Registration Forms is accurate and kept up to date by using the “Modify” template as appropriate. You agree to abide by all applicable national and international laws and regulations and are solely responsible for all acts or omissions that occur through your use of the services, including all activities that take place under your email account. You will at all times abide by the terms and conditions in the Terms of Use and in the Privacy Policy, including but not limited to abiding by the Code of Conduct below and the rules regarding Proprietary Rights.

Code of Conduct You understand and agree that AFROWOMEN™ in Digital may review and delete any material or content, including but not limited to text, comment, message, photo, or profile that in the sole judgment of AFROWOMEN™ in Digital does not comply with this Agreement, applicable law or regulation, or which might be offensive, illegal or that might violate the rights, harm, or threaten the safety of other users. AFROWOMEN™ in Digital will regularly monitor the Services for inappropriate and illegal contents posted by the users. The number of users and amount of contents in the Services is very large, and therefore it is not possible for AFROWOMEN™ in Digital to monitor all and every material posted on the Services. If an illegal or inappropriate material or content escapes AFROWOMEN™ in Digital’s notice when monitoring, this is not to be seen as AFROWOMEN™ in Digital approving of such material or content and AFROWOMEN™ in Digital has no responsibility or liability for such material or content. AFROWOMEN™ in Digital assumes no responsibility or liability for the conduct of users, including you, submitting any such material or content. It is very important that you report any illegal or inappropriate contents that you become aware of to AFROWOMEN™ in Digital or by clicking on [“Report Inappropriate Contents”].

You are entirely responsible for the material or content that you publish or display or in any other way make available on or through any of the Services or in any other way transmitted to other Users. Material or content is not automatically reviewed by AFROWOMEN™ in Digital before posted and does not necessarily reflect the opinions or policies of AFROWOMEN™ in Digital. AFROWOMEN™ in Digital is not responsible for the accuracy and reliability of the material or content or other information provided by the users or any other information that you transmit to other users.

The list below is a partial list of the kind of contents that is illegal or prohibited to post on or through the Services and the kind of activity that is illegal or prohibited on the Website and through your use of the Services. Note that the list cannot be made complete but should be regarded as a guideline to the spirit of what is prohibited. AFROWOMEN™ in Digital reserves the right to inspect and take appropriate legal action against anyone who infringes this prohibition, including but not limited to, removing the offending material or content from the Services, terminating the membership of the violator, and reporting to the appropriate law enforcement authorities. Prohibited material or content includes, but is not limited to, material or content that:

  • Are offensive and promote racism, prejudice, hatred or physical harm against any individual or group;
  • Exploit people in a sexual or violent manner;
  • Display pornographic, sexually explicit, or violent material of any kind;
  • Harass or encourage harassment of another individual or group;
  • Promote criminal activity such as drug dealing, trafficking, child pornography, fraud, obscene material, gambling, harassment, stalking, spamming, sending of harmful computer files, theft of trade secrets, or intrusion of copyright or patent rights;
  • Provide any street addresses, photographs of another person, telephone numbers, e-mail addresses, or any other personal information of that kind without consent from that individual;
  • Use any information from the Services in order to stalk, harass, abuse, or harm another person;
  • Promote information that you know is false or misleading or promotes illegal activities or conduct that is defamatory or libelous;
  • Involve transmission of “junk mail,” “chain letters,” or “spamming”;
  • Promote contests, sweepstakes, or sale of shares in any scheme (for instance but not limited to pyramid schemes or chain letters);
  • Post any photograph or other digital image of another person without his/her consent that violates the rights of privacy or publicity or any other rights of that person;
  • Solicit passwords or personal identification information for commercial or unlawful purposes from other users; and
  • Include materials or contents that in the sole judgment of AFROWOMEN™ in Digital are objectionable or which restrict or inhibit any other person from using or enjoying the Services or which may expose AFROWOMEN™ in Digital or its users to any harm or liability of any type.

By using the AFROWOMEN™ in Digital website, you agree not to:

  • Use the Services in any manner inconsistent with all applicable national and international laws and regulations;
  • Further or promote any criminal activity or enterprise or provide information on how to engage in criminal or other illegal activities;
  • Get access to information about any other person than yourself for the purpose of identifying and contacting the person or engage in illegal activity or engage in commercial activity;
  • Advertise or sell any products or services to other users without their prior explicit consent;
  • Use any information obtained from the Services in order to harass, abuse, or harm another person;
  • Post on the Services materials or contents that are inaccurate, misleading, defamatory, or offensive to AFROWOMEN™ in Digital or any other person;
  • Post materials or contents on the Services that in any way are not in compliance with the list of Prohibited Material or Content in this Code of Conduct;
  • Use any automatic device or computer program in order to monitor, use, or copy the Services or any material or content on the Services;
  • Use the Services to forward any material or content to other users which, in AFROWOMEN™ in Digital’s opinion, is unreasonable, offensive, defamatory, or any material or content which is in breach of the list of Prohibited Material or Content in this Code of Conduct;
  • Post any materials or contents on the Services that are commercial in nature unless such materials or contents are explicitly allowed under these Terms or unless AFROWOMEN™ in Digital has given prior explicit approval.

AFROWOMEN™ in Digital reserves the right, in its sole discretion, to reject, refuse to post, or remove any posting by you, or to restrict, suspend, or terminate your access to all or any part of the Services at any time, for any or no reason, without prior notice, and without liability.

Termination These terms are effective until terminated by either party. You may terminate these terms at any time by discontinuing your access to and use of the site and by destroying all materials obtained from the site. Your access to the site may be terminated immediately without notice from AFROWOMEN™ in Digital if, in AFROWOMEN™ in Digital’s sole discretion, you fail to comply with any term or provision of these terms. Upon termination, you must cease use of the site and destroy all materials obtained from the site and all copies thereof, whether made under the terms of this agreement or otherwise.

Disclaimer To the fullest extent permitted by applicable laws, AFROWOMEN™ in Digital disclaims all warranties, conditions, and other terms of any kind, whether express or implied, in relation to this site and its contents (including, without limitation, any implied warranties or conditions concerning satisfactory quality or fitness for a particular purpose). Your statutory rights as a consumer (if any) are not affected by this clause.

Liability To the fullest extent permitted by applicable laws, AFROWOMEN™ in Digital shall not be liable for any direct, indirect, or consequential damages, whether in contract, tort (including negligence), or otherwise, arising in connection with this agreement, including the use of this site or the contents thereof, or inability to use this site, including, without limitation, damages for loss of business or goodwill, loss of profits, loss of anticipated savings, loss of business relationship, or any other consequential loss.

Changes to the Agreement AFROWOMEN™ in Digital reserves the right to modify this Agreement at any time and your continued use of the site following the posting of any changes to this Agreement constitutes your acceptance of the changes. It is your responsibility to review this Agreement regularly to ensure you are aware of any changes.

Governing Law These terms shall be governed by and construed in accordance with the laws of Uganda. You agree that the Ugandan courts shall have exclusive jurisdiction to determine any disputes that arise out of or in connection with these terms.
